Currently, compulsory schooling in Luxembourg covers children aged 4 to 16. From September 2026, this obligation will be extended to 18 years of age.

What are the consequences for employers?

From September 2026, employment contracts for students outside of school holidays, whether fixed-term “student” contracts or fixed-term/permanent contracts under common law, may only be concluded with students who have reached the age of 18, in accordance with this new compulsory schooling requirement.

This new compulsory schooling requirement does not affect student contracts concluded during school holidays; this type of contract may still be concluded with pupils or students aged between 15 and 27 inclusive.

What should you do?

Be particularly careful when concluding new student contracts. Ensure that your candidates comply with this new condition from September 2026 onwards to guarantee compliance with the legislation.
