Several changes were made to the special leave to which employees are entitled for personal events:

Paternity leave or 'pappecongé'

This has been opened to the self-employed and to same-sex couples for the second parent.

It has been extended in the case of multiple births; the second parent is entitled to 20 days' paternity leave for the birth of twins.

In addition, if the employee has not informed the employer at least 2 months in advance of the foreseeable dates on which he wishes to take this leave, the 10 days' leave will have to be taken at one time and immediately after the birth of the child, unless the employer and employee agree to use a flexible solution. Previously, the employer could decide to reduce this leave to 2 days, so the other days paid by the State were lost for the employee.

The reimbursement request for companies is now digital and must be submitted via MyGuichet.

New extraordinary leave for "force majeure due to urgent family reasons”

Employees are entitled to 1 day's extraordinary leave (out of a 12-month employment period) for reasons of force majeure linked to urgent family reasons in the event of illness or accident making the employee's immediate presence indispensable. We are speaking about 8 hours (for a full-time employee) that can be split. The employer can claim reimbursement of 50% of the wage paid by submitting a request for reimbursement via MyGuichet.

New extraordinary "caregiver leave”

The employee is entitled to 5 days' extraordinary leave (over a 12-month employment period) to provide personal care or assistance to a family member or to a person living in the same household who requires considerable care or assistance for serious medical reasons which reduce their capacity and autonomy rendering the family member or the aforementioned person unable to compensate for or cope autonomously with physical, cognitive or psychological impairments or health-related constraints or necessities and which is certified by a doctor.

The 40 hours (for full-time work) can be split.

The employee must notify the employer on the 1st day of absence and submit a medical certificate drawn up by a doctor within 3 days.

The employer can claim reimbursement of 50% of the wage paid by submitting a request for reimbursement via MyGuichet.
